The terms for using The Agility Club website, iPhone and iPad app, course designer, journals, title tracking, wellness tools, clubs, teams, trial tools, and shared pages.

1. Agreement to These Terms

These Terms and Conditions ("Terms") are a legal agreement between you and The Agility Club ("we," "us," or "our"). They govern your access to and use of our website, iPhone and iPad app, shared course pages, invite links, TestFlight beta links, club tools, and related products and services (collectively, the "Services").

By accessing or using the Services, creating an account, joining a club or team, sharing a course, joining the beta, or continuing to use the Services after an update, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old, or the age of legal majority where you live, to create an account. Junior handlers may use the Services only with permission and supervision from a parent or legal guardian who accepts these Terms.

2. The Services

The Agility Club gives agility handlers, coaches, and clubs one place to design courses, manage trial-day work, track titles, log training and runs, monitor workload, and keep dog history organized.

The Services may include:

  • Course design tools for placing, rotating, numbering, saving, organizing, sharing, and exporting agility courses
  • Automatic dog pathing and course-analysis views that estimate possible lines through a course
  • Trial and training journals for runs, classes, notes, placements, times, faults, milestones, and daily context
  • Title tracking, timeline views, speed and statistics context, and multi-dog history
  • Training load, wellness notes, recovery context, injury alerts, and dog-care tools
  • Club, team, coaching, invite, roster, event, announcement, course-map, staff, and trial-day organization tools
  • Website pages that preview shared courses, profiles, club invites, team invites, and app links
  • TestFlight beta, feedback, and support tools

We may add, change, suspend, limit, or discontinue features as the product evolves. We may also impose reasonable limits on storage, usage, sharing, exports, or other parts of the Services to protect performance, security, and the experience of other users.

3. Limited License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own lawful agility, training, coaching, club, event, or personal recordkeeping purposes. We reserve all rights not expressly granted to you.

4. Accounts and Security

You are responsible for the information you provide, the activity on your account, and keeping your login credentials secure. Please use accurate information, keep your account details current, and notify us if you believe your account has been accessed without permission.

We may suspend or terminate accounts that violate these Terms, create security risk, abuse the Services, infringe someone else's rights, or interfere with the experience of other users, clubs, or teams.

5. Subscriptions, Ads, and Payments

The Agility Club is free to join. Our current product promise is that useful core features, including course design, run logging, title tracking, dog history, wellness notes, and training load tools, are not gated simply because a handler has not paid.

Paid plans may remove ads, add convenience, provide early access, support club or event tools, or enable other paid services shown in the app. Prices, renewal terms, trials, and included benefits are shown at the point of purchase and may change over time.

If app subscriptions or in-app purchases are enabled, they are generally handled through Apple. You can manage Apple subscriptions through your Apple account. Refund requests for Apple purchases are handled by Apple.

Payment processing services for club, event, payout, or platform-payment features may be provided by Stripe and may be subject to the Stripe Connected Account Agreement, Stripe Recipient Agreement, Stripe Services Agreement, or other Stripe terms that apply to the feature. By using payment or payout features, you agree to provide accurate and complete information and authorize us to share account, identity, business, and transaction information with Stripe as needed to provide those services. Stripe processes personal data as described in Stripe's Privacy Policy.

6. Your Content

You keep ownership of the courses, dog profiles, journals, training logs, wellness notes, club materials, photos, comments, files, and other content you create or upload ("User Content").

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, transmit, adapt, and create technical derivatives of your User Content solely as needed to operate, protect, improve, and support the Services. For example, we need this permission to sync your courses, render shared links, calculate title progress, show a club roster, display course maps to people you share with, generate exports, and provide support.

When you publish, share, invite, or post content in a shared space, other people may be able to view, save, copy, discuss, or use that content depending on the feature and privacy settings. You are responsible for choosing what to share and for having permission to share information about other handlers, dogs, clubs, judges, events, or organizations.

7. Acceptable Use

You agree not to:

  • Use the Services for unlawful, misleading, abusive, harassing, discriminatory, or harmful activity
  • Impersonate another person, club, judge, organization, dog, or representative
  • Submit false trial results, title claims, scores, memberships, payment information, identity information, or club information
  • Upload content you do not have the right to use or share
  • Interfere with the Services, bypass security, exceed rate limits, access systems without permission, or probe for vulnerabilities except through a responsible security disclosure process
  • Scrape, harvest, crawl, copy, or bulk export content, user data, courses, club information, or app output except through features we intentionally provide
  • Collect personal information about other users without their consent
  • Use the Services to train, evaluate, benchmark, or improve machine learning, artificial intelligence, computer vision, mapping, pathing, analytics, scoring, title-tracking, or competing software systems without our written permission
  • Use club, team, coaching, or trial tools in a way that disrupts an event, misleads handlers, interferes with official records, or harms another user

8. Proprietary Technology and Reverse Engineering Restrictions

The Services include proprietary software, algorithms, models, formulas, heuristics, workflows, data structures, scoring logic, title-tracking logic, course-analysis tools, automatic dog-pathing systems, training-load calculations, wellness-alert logic, user-interface flows, and other purpose-built technology developed for The Agility Club ("Proprietary Technology").

Except to the limited extent a restriction is prohibited by applicable law, you agree that you will not, and will not assist anyone else to:

  • Reverse engineer, decompile, disassemble, translate, adapt, reconstruct, derive, extract, or attempt to discover the source code, object code, architecture, algorithms, formulas, models, heuristics, parameters, data schemas, non-public APIs, or underlying ideas of the Services or any Proprietary Technology
  • Copy, clone, emulate, benchmark, map, monitor, scrape, or analyze the Services for the purpose of creating, training, validating, improving, or enabling a competing or substitute product or service
  • Circumvent, disable, or interfere with license controls, access controls, usage limits, privacy settings, security features, technical protections, entitlement checks, subscription checks, or app-integrity controls
  • Use automated tools, bots, scripts, instrumentation, packet inspection, app tampering, jailbreak-based analysis, unauthorized API calls, or similar methods to inspect or extract non-public functionality or data
  • Remove, obscure, or alter proprietary notices, copyright notices, attribution, trademarks, watermarks, or app-identifying information

No license is granted to the Proprietary Technology except for the limited right to use the Services as provided in these Terms. Feedback, feature requests, bug reports, and suggestions you submit may be used by us without restriction or compensation.

9. Course Design and Pathing Disclaimer

The course designer and dog pathing tools are planning, practice, educational, and organizational tools. A generated path is an estimate, not a prediction of how a specific dog will run. Actual movement depends on training, handling, speed, surface, obstacle setup, weather, health, ring conditions, and many other factors.

You are responsible for checking any course against the rules, spacing, safety requirements, and approval processes of the organization, venue, judge, instructor, or club using it.

10. Health and Veterinary Disclaimer

Training load, wellness notes, injury alerts, conditioning context, dog history, and recovery tools are informational. They are not veterinary advice and do not diagnose, treat, cure, or prevent disease, injury, or any medical condition.

Always consult a qualified veterinarian or appropriate professional before changing a dog's training, competition, recovery, conditioning, medication, treatment, or care plan. Do not ignore professional advice because of information shown in the app.

11. Clubs, Teams, Coaching, and Trials

Club, team, coaching, and trial features are administrative tools. Clubs, trial secretaries, trial chairs, coaches, instructors, judges, and event staff remain responsible for official records, entries, scores, placements, qualifying status, catalogs, results, submissions, safety decisions, and compliance with governing organization rules.

Any app-generated calculations, run orders, result summaries, title progress, event pages, announcements, course maps, staff assignments, or shared results should be reviewed before being treated as official. Real-time or shared information may be incomplete, delayed, or corrected later.

12. Privacy and Data

Our Privacy Policy explains how we collect, use, share, and protect information. By using the Services, you agree that we may process information as described there.

The Services use cloud infrastructure and third-party providers so the app can sync data, render shared pages, support invites, process purchases, provide payment tools, and provide beta access or feedback tools.

13. Intellectual Property

The Agility Club name, app, website, design, software, user interface, graphics, logos, course-design tools, pathing logic, and related materials are owned by us or our licensors and are protected by copyright, trademark, trade secret, contract, and other laws.

References to AKC, USDAA, NADAC, CPE, UKI, or other agility organizations are for compatibility, recordkeeping, or informational purposes. The Agility Club is not affiliated with, endorsed by, or sponsored by those organizations unless we state otherwise.

14. Third-Party Services

The Services may link to or rely on third-party services such as Apple, TestFlight, cloud infrastructure providers, Stripe, email providers, analytics tools, governing organization websites, club resources, trial entry services, payment services, survey providers, or social platforms. We are not responsible for third-party content, availability, policies, payments, decisions, or errors.

15. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available." We do not promise that the Services will always be available, error-free, secure, complete, or suitable for a particular use.

To the fullest extent allowed by law, The Agility Club and its owners, employees, contractors, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, event disruption, dog injury, handler injury, or reliance on inaccurate app output.

To the fullest extent allowed by law, our total liability for any claim related to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred dollars ($100).

16. Indemnification

You agree to defend, indemnify, and hold harmless The Agility Club from claims, damages, liabilities, costs, and expenses arising from your use of the Services, your User Content, your violation of these Terms, your violation of another person's rights, your misuse of Proprietary Technology, or your use of club, coaching, payment, or trial tools.

17. Termination

You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms, create risk, or use the Services in a way that harms the product or other users. Sections that by their nature should survive termination will survive, including ownership, license, Proprietary Technology restrictions, disclaimers, limitation of liability, indemnification, and dispute provisions.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Before filing a formal claim, you agree to contact us at theagilityclubsupport@gmail.com so we can try to resolve the issue informally.
